LEGAL ENGLISH TUTORIAL: Opening Statement

Overview
The opening statement is a lawyer’s first opportunity to address the jury in a trial. Generally, the party who bears the burden of proof (plaintiff in a civil case or prosecution in a criminal case) begins the opening statements, followed immediately after by the adverse party (defendant).

Purpose
Opening statements are intended to give the jury a preview of the case. An opening statement describes the parties, outlines the nature of the issue in dispute , presents a concise overview of the facts and evidence so that the jury can better understand the overall case, frames the evidence in a way that is favorable to the counsel’s theory of the case, and outlines what the counsel expects to prove.

While a good opening statement is persuasive, it should not argue the facts of the case or ask the jury to make any inferences or judgments.

Waiver
A party may elect to waive their right to make an opening statement, but that generally does not preclude the opposing party from making an opening statement.

The defense may choose not to make an opening statement so that they do not lock themselves into one theory for acquittal , which affords them the flexibility to pursue an affirmative defense or rely on the inadequacy of the opposing party’s evidence to meet the burden of proof.

💥What are Stealth Taxes?

✅Stealth taxes are an indirect form of taxation that goes unnoticed by the party who ultimately pays it. The defining feature of a stealth tax is that a formal taxpayer passes tax costs along to others in the form of higher prices or lower dividends. In such cases, the final payer of the tax is unaware that they are shouldering the burden.

✅Governments use stealth taxes to increase revenue without raising the ire of taxpayers. Stealth taxes can also arise from government regulations that do not directly raise any tax revenue, but still increase the cost of doing business.

✅Stealth taxes are a form of taxation that isn’t immediately obvious to the party paying it.
✅Stealth taxes are typically levied on businesses, which then pass them along to shareholders, customers, workers, or other parties.
✅For instance, stealth taxes are often built into a product’s price, in which case consumers may be unaware of how much of a price is going toward tax costs.
✅Stealth taxes can occur without any formal tax getting paid to the government.

💥What is unique selling point (USP)?

✅A unique selling point (USP), also called a unique selling proposition, is a marketing statement that differentiates a product or brand from its competitors. A USP might boast the lowest cost, the highest quality, the most experience, the first in its product class or another trait that sets the offering apart from the competition. A unique selling point can be thought of as “what you have that competitors don’t.”

✅A successful USP promises a clearly articulated benefit to consumers, offering them something that competitive products can’t or don’t offer. The USP should also be compelling enough to attract new customers. It carefully balances what the customer wants with what the business does well or what it can deliver that the others cannot. The idea is to make the product or brand stand out from the competition in some unique way. The USP should appeal to what the customer cares about and clearly differentiate the company’s offering from everyone else.

🔔Liability management is the practice by banks of maintaining a balance between the maturities of their assets and their liabilities in order to maintain liquidity and to facilitate lending while also maintaining healthy balance sheets. In this context, liabilities include depositors’ money as well as funds borrowed from other financial institutions.

🔔 A bank practicing liability management looks after these funds and also hedges against changes in interest rates. A bank can face a mismatch between assets and liabilities because of illiquidity or changes in interest rates; and liability management reduces the likelihood of a mismatch.
